Terms of Service

1. Eligibility

You must be at least 13 years of age (or the minimum digital consent age in your jurisdiction, whichever is higher) to use the App. By using the App you represent that you meet this requirement. If you are using the App on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

2. Description of the Service

Send Gram is a mobile application that lets users compose and send personalised grams — messages, digital cards, or photo-based content — to other people. The App is provided for personal, non-commercial use only unless we expressly agree otherwise in writing.

3. Accounts

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@hallmedia.tv if you suspect unauthorised access to your account.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not use the App to:

• Send content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable.
• Infringe upon or misappropriate the intellectual property rights of any third party.
• Distribute spam, phishing content, or unsolicited commercial messages.
• Transmit malware, viruses, or other malicious code.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Use automated means (bots, scrapers, crawlers) to access or interact with the App.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Violate any applicable local, national, or international law or regulation.

5. User Content

You retain ownership of any content you create and send through the App ("User Content"). By using the App, you grant Hallmedia a limited, non-exclusive, royalty-free licence to transmit and store your User Content solely to the extent necessary to deliver it to the intended recipient and to operate the App.

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not violate the rights of any third party or any applicable law.

6. Intellectual Property

The App and all of its content, features, design elements, and functionality (excluding User Content) are owned by Hallmedia or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

7. Third-Party Services and Platforms

The App is distributed through the Apple App Store and the Google Play Store. Your use of those platforms is subject to their respective terms of service. Hallmedia is not responsible for any acts or omissions by Apple Inc. or Google LLC.

The App may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or availability of any third-party service.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HALLMEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF HALLMEDIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL HALLMEDIA'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HALLMEDIA IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $10.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hallmedia and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by uninstalling it from your device.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App will be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or confidentiality.

13. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through an in-app notice. Continued use of the App after the revised Terms take effect constitutes your acceptance of the changes.
